1. License

Active Up grants you a non-exclusive license to install and use a copy of the software on a single server held or controlled by you. You may transfer the software between servers only if it is first removed from the old computer prior to being installed on the new one. You may only install and use the software within your own organization. You shall not reverse engineer, disassemble or decompile all or part of the Program. You are permitted to copy the documentation only for your own use. You are permitted to make only one back-up copy. The sale and sub-licensing of the software are forbidden. This license shall not be transferred or assigned without the prior written agreement of Active Up or an approved distributor.

2. Evaluation License

The standard software version is free of charge. It may be freely distributed on the sole condition that it is not altered in any way. ActiveWebControls Standard version can't be used in commercial applications.

3. Developer License

You are granted a license as a single developer (individual) to distribute ActiveWebControls royalty-free with an unlimited number of applications, provided they are developed solely by you. At no time may the software be used by more than one individual at the same time for development purposes – nor may the software be distributed for use with applications other than those developed by you.

You are required to ensure that the software is not distributed in any form that allows it to be reused by any application other than that with which you distribute it. For example, if you install ActiveWebControls control along with a packaged application on a customer's server, that Customer is not permitted to use the control independent of your application.

4. Source Code License

You can register the software to access to the royalty free source code version of the software. This registration will allow you to use the source code conforming our source code license agreement below. One license is required per developer working with Activeree.

  1. License Grant. Active Up SPRL grants the Licensee, and the Licensee hereby accepts, a non-exclusive, perpetual license to install, use, modify, prepare derivative works, incorporate into other computer software, and distribute the version noted above of the computer software program noted above, in binary and source code format, or any derivative work thereof, together with any associated media, printed materials, and on-line or electronic documentation (if any) provided by Active Up SPRL (collectively, the "Software"), subject to the following terms and conditions: (i) any distribution of the Software shall bind the receiver to the terms and conditions of this Agreement; (ii) any distribution of the Software in modified form shall clearly state that the Software has been modified from the version originally obtained from Active Up SPRL.
  2. Copyright. Retention of rights. The above license grant is conditioned on the following: (i) the Licensee must reproduce all copyright notices and other proprietary notices on any copies of the Software and the Licensee must not remove such notices; (ii) in the event the Licensee compile the Software, the Licensee will include the copyright notice with the binary in such a manner as to allow it to be easily viewable; (iii) if the Licensee incorporate the Software into other code, the Licensee must provide notice that the code contains the Software and include a copy of the copyright notices and other proprietary notices. All copies of the Software shall be subject to the terms of this Agreement. (a) the Licensee hereby acknowledges that the Software is protected by Belgian copyright law and international treaty provisions; (b) Active Up SPRL, and its licensors (if any), hereby reserve all rights in the Software which are not explicitly granted to the Licensee herein; (c) without limiting the generality of the foregoing, Active Up SPRL and its licensors retain all title, copyright, and other proprietary interests in the Software and any copies thereof, and the Licensee do not acquire any rights, express or implied, in the Software, other than those specifically set forth in this Agreement.
  3. Confidentiality. The Licensee acknowledges and agrees that the Software constitutes the confidential and proprietary trade secrets of Active Up SPRL and its suppliers, and that Licensee's protection thereof is essential to this Agreement and a condition of Licensee's use and possession of the Software. The Licensee shall retain in strict confidence any and all elements of the Software and use the Software only as expressly licensed herein. The Licensee agrees that it will under no circumstances distribute or in any way disseminate or disclose the Software to third parties.

THE TINYMCE SOFTWARE LICENSE AGREEMENT

This License Agreement is a legal agreement between you ("LICENSEE") (either an individual or a single entity) and Moxiecode Systems AB ("MOXIECODE") for the software product TinyMCE which includes computer software and electronic documentation (collectively the "SOFTWARE").

The terms of this license is not time restricted, it will remain valid for as long as the SOFTWARE is licensed under the LGPL license.

This license overrides the LGPL license for the SOFTWARE, unless this license is found invalid.

This license agreement is only valid if LICENSEE has completed the payment for the commercial license.

By installing, copying, or otherwise using the SOFTWARE, you agree to be bound by the terms of this License Agreement.

If you do not agree to the terms of this License Agreement, MOXIECODE is unwilling to license the SOFTWARE. In such event, the LGPL license will count as the valid license agreement.

YOU AGREE THAT YOUR USE OF THE SOFTWARE ACKNOWLEDGES THAT YOU HAVE READ THIS LICENSE, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.

The LICENSEE is allowed to remove any copyright notices, and does not need to inform users that they are using the SOFTWARE.

2. Restrictions

LICENSEE may not:

In such event, LICENSEE must destroy all copies of the SOFTWARE and all of its component parts. All provisions relating the ownership, disclaimer of warranties, limitation of liability and the general provisions shall survive the termination of this License Agreement.

4. Ownership

The SOFTWARE is licensed, NOT sold. The foregoing License Agreement gives LICENSEE limited rights to use the SOFTWARE.
All rights, title and interest, including all copyrights, in and to the SOFTWARE and any copies LICENSEE is permitted to make herein are exclusively owned by MOXIECODE and/or its suppliers and are protected by copyright, trademark and trade secret law and international treaties. MOXIECODE retains all rights not expressly granted to LICENSEE in this License Agreement.

5. Limited Warranty.

MOXIECODE warrants to you that for a period of fifteen (15) days from the date of purchase, as evidenced by a copy of the receipt, the media on which SOFTWARE is furnished (if any) will be free of defects in materials and workmanship under normal use. Except for the foregoing, SOFTWARE is provided "AS IS". Your exclusive remedy and MOXIECODE's entire liability under this limited warranty will be at MOXIECODE's option to replace SOFTWARE or refund the fee paid for SOFTWARE.

6. DISCLAIMER OF WARRANTY.

11. Entire Agreement

This License Agreement constitutes the entire agreement between LICENSEE and MOXIECODE and supersedes any other prior agreements or understandings, whether oral or written, regarding the SOFTWARE. If a provision of this agreement is deemed null and void, invalid or  without effect, the remainder of this agreement shall remain in effect.
